Resumen

La motivación en los actos administrativos del Gobierno Autónomo Descentralizado Municipal de Riobamba es esencial para garantizar decisiones claras, legítimas y ajustadas al marco legal. Su adecuada fundamentación fortalece la seguridad jurídica local y promueve la confianza ciudadana en la gestión pública. EL objetivo general fue analizar la motivación en los actos administrativos emitidos por el Gobierno Autónomo Descentralizado Municipal de Riobamba y su impacto en la garantía de la seguridad jurídica a nivel local. Se empleó un enfoque mixto para analizar la motivación en actos administrativos del GAD de Riobamba y su impacto en la seguridad jurídica. Se revisaron 100 actos emitidos en 2023 y se encuestó a 50 ciudadanos sobre la claridad y fundamentación de dichos actos. El análisis evidenció que muchos actos administrativos del GADMR no cumplen plenamente con los requisitos del artículo 100 del COA. Se identificaron deficiencias como ausencia de motivación, argumentos impertinentes y uso de lenguaje técnico complejo. Además, el 75% de los ciudadanos encuestados reportó dificultades para comprender las resoluciones, debido a la falta de claridad y accesibilidad del lenguaje. La insuficiente motivación en los actos administrativos compromete la legalidad y transparencia institucional. Es urgente fortalecer las capacidades técnicas del GADMR y adoptar un enfoque centrado en el ciudadano, con resoluciones claras, fundamentadas y comprensibles que fortalezcan la seguridad jurídica local.

Abstract

Motivation in the administrative acts of the Decentralized Autonomous Government of Riobamba is essential to ensure clear, legitimate decisions aligned with the legal framework. Proper justification strengthens local legal certainty and fosters citizen trust in public management. The general objective was to analyze the motivation in the administrative acts issued by the Decentralized Autonomous Government of Riobamba and its impact on the guarantee of legal certainty at the local level. A mixed-method approach was used to analyze the motivation in administrative acts of the GAD of Riobamba and its impact on legal certainty. A total of 100 acts issued in 2023 were reviewed, and 50 citizens were surveyed regarding the clarity and reasoning of these acts. The analysis revealed that many administrative acts of the GADMR do not fully comply with the requirements of Article 100 of the Organic Administrative Code (COA). Identified deficiencies included lack of motivation, irrelevant arguments, and the use of overly technical language. Furthermore, 75% of surveyed citizens reported difficulties in understanding the resolutions, mainly due to the lack of clarity and accessibility in the language used. Insufficient motivation in administrative acts undermines institutional legality and transparency. It is urgent to strengthen the technical capacities of the GADMR and adopt a citizen-centered approach, with resolutions that are clear, well-reasoned, and easy to understand, in order to reinforce local legal certainty.
